Workbooks for family separation or creating a future together
At Klinkert Law we work with separating families and also with couples who want to plan their future together.
The Workbooks we use in family matters are designed to assist our clients to prepare themselves for the road ahead in their own time before they meet with us, either as their chosen lawyer or mediator.
Mediation: How we work with Separating Couples
If a couple comes to us wanting mediation assistance to work out their relationship separation, both people are provided with a Workbook. Some couples find they can work out some aspects of their separation fairly easily, but really struggle with others. Other couples need mediation to help with most of their decisions. The Workbook helps clients prepare for their work with us, so that we can determine at an early stage what matters most, and where clients need help.
The Workbook
It was designed by our Canadian colleague, Jacinta Gallant and adapted for use in New Zealand as well as several other countries around the world. It has lots of open space for notes and scribbles. It includes self-reflection, exercises, legal information, and practical tips. You can think of it as a private journal. No one else needs to see it or you can choose to share it. We ask that our clients commit to fully completing the exercises, as this will directly impact on the effectiveness and efficiency of their mediation process.
We use three versions of the Workbooks. There is a book for separating couples with children (Two Homes workbook). Then there is also a book for separating couples with blended families (A Few Homes workbook). We also have a book for couples who want to work out a way to grow together (Future Together workbook). Wanting to work things out with your partner? Perhaps you are thinking of entering into a Property Agreement, also commonly known as a Contracting Out Agreement or pre-nup?
If you would like some help, our Workbook - “Designing Our Future Together” assists our clients to have conversations with their partners and with their chosen legal professional to reach agreement and for us to then draft the agreement.
What we ask of our Clients
Whether we work with you as your lawyer or your mediator, you will be asked to complete either the whole Workbook (Designing Our Future Together) or at least the first pages 1-13 (Two Homes) (page 1-20 for A Few Homes).
For our separating clients: You do not need to share your answers with your partner. What you write in the Workbook is for your own reflection. When you meet with us individually, we will discuss how we can best help you have productive discussions, and we will give you more guidance for the next stage – a joint session with your ex-partner.
You will find that as you read through the Workbook, you may consider which decisions might be more challenging to work out. The Workbook will direct our discussions. It is different for everyone and each couple.
